Terms of service
These Terms of Service govern your use of Odara Gallery (the "Site") and any purchase you make through it. By placing an order or otherwise using the Site, you agree to these terms. If you don't agree, please don't use the Site.
Who we are
Odara Gallery sells original artwork to collectors worldwide, including in the United States, the European Union, and the United Arab Emirates. You can reach us at support@odara.gallery.
The marketplace model
Every artwork listed on the Site is created and owned by an independent artist until purchase. Artworks ship directly from the artist, not from a central Odara Gallery warehouse. We facilitate the listing, sale, and payment process, and we stand behind every transaction, but production and packaging is carried out by the artist under our quality guidelines.
Orders and pricing
All prices are shown in the currency displayed at checkout and are subject to change without notice until an order is placed. We reserve the right to refuse, cancel, or limit any order at our discretion, including where we suspect fraud, unauthorized or illegal activity, pricing or listing errors, or a violation of these terms. If we cancel an order after payment, you'll receive a full refund.
Artwork descriptions and images
We work with artists to represent each piece as accurately as possible, including photos, dimensions, and materials. Because original artwork is handmade, minor variations in color, texture, or finish between photos and the physical piece are normal and are not grounds for a claim on their own — see our Return & Refund Policy for what does qualify.
Intellectual property
Artists retain copyright and all intellectual property rights in their artwork unless otherwise agreed in writing. Purchasing a piece transfers ownership of that physical object only, not the right to reproduce, display commercially, or create derivative works from the image or design, except for your own personal, non-commercial use (for example, sharing a photo of your piece on social media). Site content — including text, layout, graphics, and the Odara Gallery name and logo — may not be copied or reused without our written permission.
Payments and chargebacks
Payments are processed securely through our payment provider; we do not store your full card details. If you have any issue with an order, please contact support@odara.gallery first — most problems can be resolved faster and more completely that way than through a bank dispute. Initiating a chargeback for an order that was accurately fulfilled and delivered, without first contacting us, may result in contesting the dispute with evidence of delivery, order communications, and our policies, and may affect your ability to order from us in future.
Shipping and returns
Shipping timelines, costs, and our return and cancellation terms are set out in our Shipping Policy and Return & Refund Policy, which form part of these Terms of Service.
Limitation of liability
To the fullest extent permitted by law, Odara Gallery's total liability for any claim relating to an order is limited to the amount you paid for that order. We are not liable for indirect, incidental, or consequential damages, including delays caused by artists, carriers, or customs authorities beyond our control.
Age requirement
You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order on the Site.
Governing law
These terms are governed by the laws of Georgia, without regard to conflict-of-law principles, except that nothing here limits any mandatory consumer protection rights you have under the law of your own country of residence. We'll always try to resolve a dispute directly with you before either party pursues formal proceedings — contact support@odara.gallery first.
Changes to these terms
We may update these terms from time to time; the version posted on the Site at the time of your order applies to that order.
